NEW FORMALITY NOT TO BE SUBJECT TO FRENCH SOCIAL CONDITIONS

The French Bylaw of 12th July 2019 states that the vessels executing more than 70% of their trips out of French waters must send their commercial activity statement to the Departmental director of the sea and the territories of the first French port touched.

Sending this commercial activity statement to the French authorities will enable the owning company of the vessel to be exempted from the application of the French social conditions’ regulations laid down in the French code of transports.

When a commercial vessel sails in France, there is a risk that the maritime authorities apply the social conditions of the hosting country to the employees onboard.

To avoid this situation, YMCA can file the procedure towards the French maritime authorities proving that your vessel, respecting the 70% fiscal rule, is also entitled to benefit from the French social condition’s exemption.

To start the procedure, we only need to know the first French port touched by the yacht in 2020 while under a commercial certificate of registry.
