INCREASE OF CUSTOMS CONTROLS IN THE MIDST OF THE PANDEMIC: BEWARE

We are currently noticing an increase of customs controls in France. We would like to remind that your vessel is subject to a specific customs and VAT status. Very often, this status comes along with stringent conditions to fulfill. The non-respect of these conditions could have very serious consequences.

 

A few examples:

 

For yachts currently imported under the French commercial exemption, do not forget to comply with the 70% rule (70% of the trips outside French waters) every calendar year. YMCA is currently in charge of several customs litigation files related to the non-compliance with the 70% rule.

 

Regarding non-EU private yachts, keep track of the time-limit of your temporary admission allowance (18 months in a row).

 

Customs can go back four years to check your past situation (seven years for more serious offenses). The sanction could be, in some cases, the reassessment of the VAT on the value of the vessel in addition to substantial fines associated with.
